Acceptance of Terms

By accessing or using the Get Right Fitness app (“App,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, do not use the App.

Eligibility

You must be at least 18 years old to use the App and be within the anthropometric measures for the App to function correctly. You may not use the App if you are prohibited from doing so under applicable law.

Use of the App

You agree to use the App for lawful purposes only. You may not:

Interfere with the operation of the App;
Misrepresent your identity or health information;
Attempt to gain unauthorized access to other accounts, systems, or networks;
Use the App to harass, abuse, or harm yourself or others.

Health Disclaimer (Summary)

The App provides general wellness, nutrition, fitness, and image-derived measurement content. It is not a substitute for professional medical advice. Always consult your doctor before making changes to your health routine. See our Health Disclaimer for more detail.

Account and Security

You are responsible for maintaining the confidentiality of your login information and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account.

Subscription and Payments

Get Right Fitness offers subscription-based services that may be purchased either through third-party platforms, such as Apple App Store and Google Play Store, or through the Get Right Fitness website.

Subscription pricing and duration are clearly disclosed at the time of purchase before confirmation.

Third Party App Subscriptions (Apple App Store & Google Play)

If you subscribe through the Apple App Store or Google Play Store, your subscription is an auto-renewable subscription managed by that platform.

For subscriptions purchased through the Apple App Store:

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period.
You can manage or cancel your subscription at any time through your Apple ID account settings.
Deleting the app does not cancel your subscription.
Payments and refunds for iOS subscriptions are handled by Apple in accordance with Apple’s policies.

For subscriptions purchased through Google Play, billing, renewal, cancellation, and refunds are governed by Google Play’s policies.

Website Subscriptions

If you create a subscription through the Get Right Fitness website:

Payments are processed through our website payment provider.
Billing, renewal, cancellation, and refund terms for website subscriptions are governed by the terms presented at checkout on the website.
Website subscriptions are managed separately from Apple App Store & Google Play subscriptions.

Legacy Pricing Eligibility

Legacy Pricing is a promotional annual subscription rate available through supported subscription platforms, subject to the applicable platform’s subscription policies.

Legacy Pricing remains active only while an annual subscription renews consecutively and without interruption. If the subscription is canceled, expires, or lapses for any reason, eligibility for Legacy Pricing is forfeited and future subscriptions will be offered at the then-current standard rate.

Legacy Pricing applies only to the subscription platform where it was originally purchased and cannot be transferred between platforms.

Pricing changes, if any, are communicated by the applicable subscription platform in advance and are subject to that platform’s subscription policies.

Refunds

Refunds for subscriptions purchased through the Apple App Store or Google Play Store are handled by the respective platform in accordance with their refund policies. Get Right Fitness does not have the ability to issue refunds for purchases made through third-party app marketplaces.

Refund eligibility for subscriptions purchased through the Get Right Fitness website is governed by the refund terms presented at the time of checkout.

Intellectual Property

All content, trademarks, logos, and software are the property of Get Right Fitness or its licensors and may not be copied, modified, or distributed without permission.

Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without notice, for any reason including violation of these Terms.

Disclaimer of Warranties

The App is provided “as is” and “as available.” We do not guarantee the accuracy or completeness of any content, including AI- or image-derived estimates.

Limitation of Liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the App.

ARBITRATION & DISPUTE RESOLUTION CLAUSE

1. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to your use of the Get Right Fitness App shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that you or we may assert qualifying claims in small claims court.

2. Class Action Waiver

You agree that disputes may only be resolved on an individual basis and may not be brought as a class action, consolidated action, or representative action.

3. Governing Law & Venue

This Agreement is governed by the laws of the State of Florida, without regard to conflict of law rules. The place of arbitration shall be Palm Beach County, Florida. By using the App, you waive the right to a jury trial.

Changes to the Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the revised Terms.
